Article 1: Recitals

These general terms and conditions of sale shall apply exclusively between SIYPS, Unit 103, Millennium Business Park, Cappagh Road, Dublin 11 (Ireland) (hereafter “Us” or “We”) and any person visiting or making a purchase on the site www.siyps.com (hereafter the “Site”).
Any such person wishing to make a purchase (hereafter “You”) shall declare that he/she is aware of these general terms and conditions of sale. Although these general terms and conditions of sale may be amended, the applicable terms and conditions shall be those in force on the Site as of the date the order is made.

Article 2: Agreement

2.1 Terms and conditions for placing an order
It is our policy to not sell alcohol to anyone under the age of eighteen in accordance with the law. By placing an order with us You are confirming You are over eighteen. If the wine You purchase is a gift then the recipient must also be over eighteen. You hereby undertake to be at least 18 years of age at the time of placing the order. You also declare that You are legally entitled to place an order on the Site.

2.2 Order confirmation
Once We receive your order We shall send You confirmation thereof by e-mail.

Article 3: Price, Availability and Delivery

3.1 Price

The prices for goods displayed for sale on the Site are as displayed on the Site, and are inclusive of VAT and Duty at rates valid as of time of purchase. Additional charges include delivery fees only, and these prices are clearly marked on the “Checkout” page, and advertised on the “Delivery” page. All prices are quoted in Euro. They include VAT and are per bottle or per case as marked. We do not accept responsibility for typographical errors. Prices can change at any time without notice.
A discount of 10% will be automatically applied to any order of 12 bottles and more within the website.

3.2 Availability
All orders shall be accepted while stocks last. We shall inform You of the availability of articles sold on the Site on the detailed information page for each article.
Despite our best efforts, it may happen that an error occurs as regards the availability or price of a limited number out of the hundreds of articles available on www.siyps.com.
If, despite these best efforts, the articles that You have ordered are unavailable, We shall inform You by e-mail as soon as possible in order to agree on how You wish to proceed with your order, i.e., partial retention, modification or cancellation. If, despite our best efforts, there is a pricing error with respect to the articles that You have ordered, please rest assured that all prices shall be checked at the time the articles are sent. If the amended price is higher than the price shown on the Site, We shall inform You in advance and cancel your order, unless You choose to accept the order at the new price.
We hereby remind You that any payment by bank card shall be debited at the time your order is validated. As such, in the event that an article is no longer available or has been invalidated by You, and that there is no replacement acceptable to You, We shall send You a reimbursement cheque.

3.3 Delivery
Your order shall be prepared as soon as your payment is validated.
The product or products shall be delivered nationwide (Republic Of Ireland and Northern Ireland), to your home or to any other address provided by You at the time of your order, within approximately one (1) calendar week, except in the event of force majeure.
Deliveries are typically made within 24 hours; however We only guarantee a 72 hour service. Deliveries outside Republic Of Ireland or Northern Ireland shall take more calendar days.
Deliveries do not take place on weekends, operating only Monday to Friday. For all orders placed between 13:00 Friday and Sunday, delivery will only take place on Tuesday.
Goods must be received by a person 18 years of age or older. Where any of our drivers are in doubt as to the age of the person receiving the goods, they reserve the right to request proof of age and / or retain the goods until they can be received by a person of or above the legal age to purchase alcohol.
Deliveries are made during business hours (usually between 9 AM and 5 PM) and somebody must be present to take delivery and sign for it. If no one is home at the time of delivery a slip will be left with the courier’s contact number on it for You to arrange a convenient time to receive or collect the wine.
Please note We are unable to arrange for the courier to deliver wine outside business hours. If You think You (or the recipient) won’t be home to accept the wine You can choose to have it delivered to a business address. It is mandatory that a contact number is provided for all delivery addresses.
Please contact Us if you have not received your wine within three working days and We will track it for you.
At peak times, particularly Christmas, your wine may take longer to arrive so We do ask You to place your orders as early as possible to avoid disappointment.
If You do have any special requirements regarding delivery please contact us and We will do our best to facilitate You.

Upon receipt of the product(s), it is incumbent on You to:
– scrupulously check the contents of the package(s) and inform Us of any reserves,
– inform Us within 24 hours, at the address listed on the Site, if articles are damaged or missing. Past this deadline, complaints shall not be considered.
If a major incident (theft or breakage) occurs during the transport of your order, We shall resend the product in question as soon as possible. In the event that the same product is unavailable, We will contact You to inform You of the reimbursement procedure to be carried out by our insurance company.
Deliveries to countries outside Republic of Ireland are possible. If your destination is not listed on our Site, please do not hesitate to contact us at: info@siyps.com
Any order delivered outside Republic Of Ireland may be subject to taxes and customs duties at the destination point. These customs duties and taxes shall be payable by You and remain your responsibility. We are not obliged to inform You of taxes and duties payable. To find out if such taxes and duties exist, please contact the relevant authorities in your country.

Article 4: Payment and Protection of personal data

You may settle your purchase by bank card. Cards issued by banks not domiciled in Republic Of Ireland must be international bank cards.
The amount of the purchase shall be debited when your order is validated. As soon as your payment by bank card is validated, your invoice will be sent by email and also available in your customer area, which You can access by logging on with the username and password chosen by You when the account was set up.
Your security and peace of mind are of the greatest importance to Us. We endeavour to take all responsible steps to protect your personal information. Any sensitive data (including personal data and payment information) you send Us from your computer is securely encrypted and protected using Internet standard encryption technology known as SSL (Secure Sockets Layer). This process scrambles any sensitive data you transmit to us, preventing it from being intercepted during transmission.
We hereby undertake to protect your personal data. Any personal data that You provide to Us shall be treated in strict confidence, in accordance with our personal data protection policy and the GDPR regulations.

Article 5: Goods property and Returns

Goods delivered shall remain our property until sent (when handed over to the appointed carrier), and You have paid the full price thereof (goods and ancillary costs).
Since great care is taken to ensure that the wines We offer are stored in ideal conditions (temperature, humidity, horizontal position, darkness), We regret that We are unable to offer a refund or replacement on the following grounds:
– Unsatisfactory taste: Bottles will not be replaced or refunded, even unopened, because You deem them corked, oxidised, past maturity, or similar.
– Damaged, torn or less than perfect label, neck label or cap: Wine bottles, and older vintages in particular, can be marked by the years they spent in the wine cellar. This damage is superficial and does not affect the quality of the contents.
The pictures displayed on your website are not contractual.

Article 6: Warranties and Liability

We shall not accept liability in the event that the article delivered does not comply with the laws of any country to which it is delivered, other than Republic Of Ireland.
We hereby undertake to act with the customary care exercised in the profession to ensure that the service proposed to the customer is implemented. However, We may not be held liable in the event that We are unable to fulfil our contractual obligations due to unforeseeable circumstances or force majeure, as defined by case law handed down by Irish courts.
We shall not be held liable in the event of a delay due to a possible shortage of stock.
We shall not be held liable in the event of differences between the photos, texts and illustrations on our Site and the articles ordered.
We shall use all means available to Us to ensure provision of the services referred to in these general terms and conditions of sale. In no event shall We be held liable for lost profit, business or data, loss of earnings or any other indirect damages unforeseen at the time of use of the Site or the time of signature of the sales agreement between Us and You.

Article 7: License to access the Site

We hereby grant You limited license to access and use our Site for your personal use. In no event shall You be authorised to download or modify all or any part of this Site without our express and written authorisation. This license shall in no event enable You to use, for sale or for any other business use, this Site or the content thereof (listed products, descriptions, prices, download or copy of information on behalf of another merchant, use of data, software, sound clips, graphics, images, texts, photographs, other resources).
In no event may this Site or part of this Site be reproduced, copied, sold or used for commercial reasons without our express and written authorisation.
You shall not use techniques enabling You to copy a brand, logo or any other information (in particular images, text or layouts) owned by Us without our express and written agreement.
Any unauthorised use of the Site shall result in termination of the license that We have granted You.
We hereby authorise You, on a non-exclusive and revocable basis, to create a link to our Site on condition that this link shall not create an untrue, false or pejorative image of Us or cause Us harm. We shall not be held liable, in any way whatsoever, for the content of your Site as regards the creation of this link. Any use of our logo, brand or graphics in your link shall require our express and written authorisation.

Article 8: Applicable law and competent jurisdiction

These general terms and conditions of sale are subject to Irish law and to the Vienna Convention on the international sale of goods. Any disputes regarding the business relationship between You and Us shall be subject to the non-exclusive jurisdiction of the Irish courts. Relevant legislation governing these Terms & Conditions is the Sales of Goods (Supply of Services) Act, 1980, the Consumer Information Act, 1978, the Electronic Commerce Act, 2000, the EU Directive on Distance Selling, SI 207 of 2001 and SI 68 of 2003, the Data Protection (Amendment) Act, 2003 and the Copyright & Related Act, 2000.
